1. Acceptance of Terms
By accessing or using the Ivy 100 Education Inc. website (ivy100edu.ca) and our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services. If you are under 19 years of age (the age of majority in British Columbia), your parent or legal guardian must review and agree to these terms on your behalf.
2. Description of Services
Ivy 100 Education provides university admissions consulting and test preparation services, including but not limited to:
- Guaranteed Admission Programs for top-tier universities
- SAT and AP test preparation and training
- Academic planning and supervision services
- Individual services including essay coaching, interview preparation, extracurricular strategy, course selection, school selection, summer program planning, application management, and ongoing mentorship
3. Consultation & Enrollment
Our consultation process begins when you submit an inquiry through our website or contact us directly. Information provided during consultation is used to assess your needs and recommend appropriate programs. Enrollment in any program requires a separate enrollment agreement that outlines specific terms, schedules, and fees applicable to the chosen program.
4. No Guarantee of Results
While Ivy 100 Education is committed to providing the highest quality guidance and instruction, we cannot and do not guarantee specific test scores, grade improvements, or university admission outcomes. Our \"Guaranteed Admission\" programs refer to specific contractual arrangements with defined conditions and are subject to the terms outlined in individual enrollment agreements. Academic and admissions outcomes depend on many factors beyond our control, including but not limited to student effort, prior academic history, and institutional admission policies.
5. Scheduling, Cancellation & Attendance
Classes and sessions must be attended as scheduled. The following policies apply:
- Cancellations must be made at least 24 hours in advance
- Late cancellations or no-shows may result in forfeiture of the session
- Rescheduling is subject to instructor and room availability
- Consistent tardiness or absences may impact program effectiveness and are the responsibility of the student
6. Payment & Refund Policy
Program fees are outlined in your enrollment agreement. Payment terms, including installment options where available, are specified at the time of enrollment. Refund eligibility is determined by the specific terms of your enrollment agreement and the stage of service delivery. Administrative fees may apply to refund processing. Please contact our office for detailed information regarding your specific program.
7. Intellectual Property
All course materials, practice tests, study guides, publications (including our SAT preparation books), website content, and other educational resources provided by Ivy 100 Education are our proprietary intellectual property or are used under license. Students are granted a limited, non-transferable, personal-use license for the duration of their enrollment. Materials may not be reproduced, distributed, shared, uploaded, or used for any commercial purpose without our express written consent.
8. Code of Conduct & Academic Integrity
Students enrolled in Ivy 100 Education programs are expected to uphold the highest standards of academic integrity:
- No cheating, plagiarism, or misrepresentation of work on any assignments, essays, or examinations
- Course materials and practice tests must not be shared with non-enrolled individuals
- Our consultants provide guidance, coaching, and feedback, but will not write essays, complete applications, or do academic work on behalf of students
- Students must respect fellow students, instructors, and staff at all times
- Violation of these standards may result in dismissal from the program without refund
9. Communication Consent
By providing your contact information (phone number, email address, and/or WeChat ID), you consent to receive communications from Ivy 100 Education regarding your program, scheduling, educational updates, and promotional information about our services. Promotional electronic messages are sent in compliance with Canada's Anti-Spam Legislation (CASL). You may opt out of promotional communications at any time by contacting us directly or using the unsubscribe mechanism provided in our electronic messages. Transactional communications related to your enrollment (such as scheduling and progress updates) are not subject to opt-out.
10. Third-Party Links & Services
Our website may contain links to third-party websites and services, including our SAT mock exam application (sat.ivy100edu.ca). While we strive to link only to reputable resources, Ivy 100 Education is not responsible for the content, privacy practices, or availability of external sites. Your use of third-party services is subject to their own terms and conditions.
11. Limitation of Liability
Ivy 100 Education provides its services and website content on an \"as is\" basis. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim shall not exceed the fees paid by you for the specific service giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Ivy 100 Education Inc., its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to:
- Your violation of these Terms of Service
- Any misrepresentation or inaccuracy in information you provide to us
- Your unauthorized sharing or distribution of our proprietary materials
- Any breach of the Code of Conduct or academic integrity standards
13. Termination
Either party may terminate the service relationship in accordance with the terms of the enrollment agreement. Ivy 100 Education reserves the right to terminate services immediately if a student violates the Code of Conduct or these Terms of Service. In the event of termination, refund terms outlined in the enrollment agreement will apply.
14. Force Majeure
Ivy 100 Education shall not be liable for any delay or failure to perform its obligations under these terms or any enrollment agreement where such delay or failure results from circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, pandemics, public health emergencies, government orders, severe weather, power outages, internet disruptions, or labour disputes. In such events, we will make reasonable efforts to resume services as soon as practicable, provide alternative arrangements (such as online instruction) where possible, and communicate promptly with affected students and families.
15. Dispute Resolution & Governing Law
These Terms of Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. In the event of a dispute arising from these terms or your use of our services, both parties agree to first attempt to resolve the matter through direct discussion. If the dispute cannot be resolved informally within 30 days, either party may pursue mediation administered by a mutually agreed-upon mediator in Vancouver, British Columbia. If mediation is unsuccessful, the dispute shall be submitted to the exclusive jurisdiction of the courts of British Columbia.
16. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these terms. The remaining provisions shall continue in full force and effect.
17. Changes to Terms
Ivy 100 Education reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated \"Last updated\" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
